OPENDIARY TERMS & CONDITIONS

These Terms & Conditions ("Terms") govern your access to and use of OpenDiary, operated by Kian Community Private Limited ("OpenDiary", "we", "our", or "us").
By creating an account, accessing, or using OpenDiary, you agree to be bound by these Terms. If you do not agree, please do not use the platform.
1. ABOUT OPENDIARY
OpenDiary is a journaling and community platform that allows users to write, publish, read, support, and comment on diary entries. OpenDiary is intended to provide a space for expression, reflection, and community interaction.
OpenDiary is not a medical service, healthcare provider, therapy provider, crisis intervention service, or professional advisory service.
2. ELIGIBILITY
OpenDiary is intended for individuals aged 18 years or older.
By using OpenDiary, you represent that you are at least 18 years old or are legally permitted to use the service under the laws applicable in your jurisdiction.
3. USER ACCOUNTS
Users may create accounts using supported authentication methods, including Google Sign-In and Apple Sign-In.
You are responsible for maintaining the security of your account and for all activity occurring under your account.
You may choose a display name and profile image where such features are available.
OpenDiary reserves the right to suspend, restrict, or terminate accounts that violate these Terms.
4. ANONYMOUS NATURE OF THE PLATFORM
OpenDiary allows users to participate using display names and does not require users to publicly disclose their real identities.
However, OpenDiary may collect certain account, technical, and payment-related information as described in the Privacy Policy.
Users are responsible for ensuring that they do not voluntarily disclose personal information they wish to keep private.
5. USER CONTENT
Users may create, publish, edit, delete, and share diary entries and comments through the platform.
Users are solely responsible for the content they post.
OpenDiary does not endorse, verify, guarantee, or assume responsibility for any user-generated content.
Users retain ownership of the content they create.
By submitting content to OpenDiary, you grant OpenDiary a worldwide, non-exclusive, royalty-free license to store, host, display, process, analyze, reproduce, moderate, categorize, and otherwise use such content for the purpose of operating, improving, securing, and promoting the OpenDiary service.
6. SOCIAL MEDIA SHARING
OpenDiary may request separate consent from users to feature selected diary entries anonymously on social media, promotional materials, or marketing campaigns.
OpenDiary will not intentionally identify users when sharing such content unless the user has expressly consented.
Users may withdraw such consent by contacting OpenDiary.
7. COMMUNITY PARTICIPATION
OpenDiary is an open community platform.
Users may read public diary entries, provide support, and leave comments on publicly visible content.
Users understand and acknowledge that comments and interactions may not always be helpful, supportive, accurate, or aligned with their personal views.
OpenDiary cannot guarantee that all interactions will be positive or emotionally beneficial.
8. PROHIBITED CONTENT
Users may not post, publish, share, promote, or distribute content that:

Harasses, bullies, or intimidates others

Contains hate speech

Targets individuals or groups based on race, caste, ethnicity, nationality, religion, gender, sexual orientation, disability, or similar protected characteristics

OpenDiary reserves the right to determine whether content violates these standards.
9. MODERATION AND ENFORCEMENT
OpenDiary may review, moderate, restrict, hide, remove, or delete content at its sole discretion.
OpenDiary may suspend or permanently terminate accounts that violate these Terms or are determined to be harmful to the community.
OpenDiary is not obligated to notify users before removing content.
Users may appeal account actions by contacting info@theopendiary.in.
OpenDiary is not obligated to restore removed content or suspended accounts.
10. AI-ASSISTED FEATURES
OpenDiary may use artificial intelligence technologies to assist with:

Platform improvement
AI-generated outputs may be inaccurate, incomplete, or misleading.
Users should independently review AI-generated content and should not treat AI outputs as professional advice.
11. PREMIUM MEMBERSHIP
OpenDiary may offer paid subscription plans including monthly, quarterly, and annual memberships.
Premium features may include:

Other premium features introduced from time to time
Subscription fees are charged in advance and are non-refundable except where required by applicable law.
12. SUBSCRIPTION RENEWALS
Certain subscriptions automatically renew unless canceled before the renewal date.
Users are responsible for managing and canceling subscriptions through the applicable payment platform.
Deleting an account does not entitle a user to a refund of subscription fees already paid.
Existing subscription benefits may continue until the end of the applicable billing period, while future renewals may be canceled.
13. THERAPIST DISCOVERY AND BOOKINGS
OpenDiary may provide users with access to information regarding mental health professionals and facilitate appointment requests.
Professional services are provided directly by the selected professional.

Users engage with therapists at their own discretion and risk.
OpenDiary is not responsible for services provided by therapists or for the therapist-user relationship.
14. MENTAL HEALTH DISCLAIMER
OpenDiary is designed as a platform for journaling, expression, and community interaction.
OpenDiary is not a substitute for professional medical care, mental health treatment, psychiatric care, crisis intervention, diagnosis, or therapy.
Users experiencing emergencies, self-harm risks, suicidal thoughts, or urgent mental health concerns should seek immediate assistance from qualified professionals or emergency services.
15. NO PROFESSIONAL ADVICE
Content available on OpenDiary, including comments, reactions, discussions, AI-generated content, and user-generated content, is provided for informational and conversational purposes only.
Such content should not be treated as medical, psychological, legal, financial, therapeutic, or professional advice.
Users rely on such content entirely at their own discretion.
16. LIMITATION OF LIABILITY
To the maximum extent permitted by law, OpenDiary and Kian Community Private Limited shall not be liable for:

Users agree to indemnify and hold harmless OpenDiary, Kian Community Private Limited, its directors, employees, contractors, and affiliates from claims, damages, liabilities, costs, and expenses arising from:

18. PLATFORM CHANGES
OpenDiary may modify, suspend, discontinue, or update any feature, functionality, subscription offering, or service at any time without liability.
19. TERMINATION
Users may stop using OpenDiary and delete their accounts at any time.
OpenDiary may suspend or terminate accounts at its discretion where it believes such action is necessary to protect users, maintain community standards, comply with law, or preserve platform integrity.
20. GOVERNING LAW
These Terms shall be governed by and interpreted in accordance with the laws of India.
Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Delhi NCR, India.
